1. Introduction
EveryNearby (“EveryNearby”, “we”, “us” or “our”) is operated by Irfan Rais, an individual proprietor trading as EveryNearby. We operate a directory of local businesses at www.everynearby.com (the “Platform”).
This Privacy Policy explains what information we collect, how we use and protect it, and the rights you hold in relation to your personal data. It is drafted with reference to the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, the Digital Personal Data Protection Act, 2023 as it comes into force, and other applicable law.
By using the Platform you acknowledge that you have read and understood this Policy. If you do not agree with it, please do not use the Platform.
2. Scope
This Policy applies to:
- Visitors to the Platform, whether or not they hold an account
- People who send an enquiry, write a review or report a listing
- Business owners who create an account, claim a listing or manage one
- People who contact us by email or any other channel
It does not cover the practices of listed businesses or of third-party websites and services linked from the Platform.
3. Data we collect
Information you provide
- Enquiries: your name, your email address or phone number, and your message
- Reviews: your name, email address, rating and review text. Your email address is never shown
- Reports: what you tell us about a listing, and your email address if you choose to give it
- Signing in: your email address, or your mobile number if you choose to sign in with it
- Your account: your name, your email address or mobile number, a password where one is set (stored only in scrambled form), and, if you choose to give them, your city and the kinds of business you are interested in
- Business accounts: the proof you send when claiming a listing, the details and changes you submit, and, if you choose to give them, your role in the business, the number of people working there, and registration numbers such as GST, Udyam (MSME), FSSAI and shop or trade licence numbers. Registration numbers are used only to confirm the business and are never shown on the listing. Your name is shown on the listing only if you choose that
If you answer “Did this number work?”, we keep your yes or no with the listing and the date, and a scrambled form of your network address so that one person counts once. We do not keep who you are or your phone number. The listing may show how many visitors said the number worked; it never shows who answered.
Information collected automatically
- Contact-button records: which contact button was used on which listing and when, with a one-way scrambled form of the network address so that repeat and automated use can be told apart. We do not store the network address itself
- Reports, enquiries and claims: the same one-way scrambled form of the network address is kept with each of them, so that repeat and automated use can be told apart. We do not store the network address itself.
- Your location: only if you choose “Near me” or “Use my location”. It is used to order that one list, or to find the nearest city we cover, and is not stored
- Technical logs: our hosting and security providers keep standard request logs for a limited period to operate and protect the Platform. When a business shows our badge on its own website, each visit to that website asks our server for the badge picture, and that request is logged like any other; we keep nothing else about those visits.
We do not collect payment information. We do not ask for PAN, Aadhaar or bank details. A GST number contains the PAN of the business or its proprietor; we treat it as confidential, never display it and use it only to confirm the registration.
4. How we use your data
- To deliver your enquiry to the business you chose
- To publish your review after it has been read
- To verify claims and keep listings accurate
- To show a business how often people contact it through its listing
- To send the messages needed to run your account
- To detect misuse, fraud and automated abuse
- To settle a case where two people say the same business is theirs, including telling each of them the result
- Where you have agreed to receive them, to send occasional updates and offers chosen to match your city and interests
- To comply with the law and lawful orders
5. Legal basis for processing
- Consent: where you choose to send an enquiry, share your location, write a review or receive optional messages
- Contractual necessity: to provide a business account and the services that go with it
- Legitimate interests: to keep the directory accurate, measure its use and prevent abuse, where these interests are not overridden by your rights
- Legal obligation: where the law or a court order requires it
6. Data sharing and disclosure
- The business you contact: an enquiry is sent to that one business and to no other
- Service providers: companies that host the Platform, protect it, deliver email and provide the software assistants that help us run it, under obligations of confidentiality
- Sign-in codes: if you sign in with your mobile number, it is passed to Message Central, the messaging provider that delivers the code by text message or WhatsApp
- Ownership cases: if someone else claims a business you manage, or you claim one that someone else manages, we tell the other person that a case is open and what was decided. We do not give them your name, contact details or the proof you sent
- Legal requirements: authorities, where we are required to disclose by law or a lawful order
We do not sell personal data, and we do not pass enquiries to businesses other than the one you chose.
7. Cookies and tracking
We use only the cookies needed to keep you signed in to your account and to protect forms and the Platform from abuse. If you choose a city, your own browser remembers it on your device so the site opens there next time; this is not a cookie, we do not receive it, and clearing this site’s data in your browser removes it. We do not use advertising cookies or third-party tracking for marketing.
8. Data security
We use reasonable technical and organisational measures to protect personal data, including encryption in transit, restricted access, a second sign-in step for staff and regular backups. No system is completely secure, and we cannot guarantee absolute security.
9. Data retention
- Enquiries are deleted 90 days after they are sent
- Contact-button records are deleted after 13 months
- Account data, including your city, interests and any registration numbers you gave, is kept for the life of the account and a reasonable period afterwards. You can clear your city and interests at any time from your account page, and remove a registration number or ask us to delete it
- Records of ownership cases are kept for as long as needed to show how a listing came to be managed by its current owner
- Reviews are kept for as long as they are published, or until you ask us to remove yours
- Records of removals and complaints are kept for as long as needed to stop a removed business being added again and to meet legal requirements
10. Your privacy rights
Subject to applicable law, you may ask us to:
- Access: give you a copy of the personal data we hold about you
- Correct: fix inaccurate or incomplete data
- Erase: delete your data where it is no longer needed or where you withdraw consent
- Withdraw consent: at any time, without affecting what was done before
- Complain: raise a grievance with our Grievance Redressal Officer
Write to info@everynearby.com. We may need to confirm your identity before acting.
11. Business listings
Listings that have not been claimed start from open place data, credited on our Data Sources page. They show business contact details such as a name, address, phone number and website. If a listing shows your personal details, or you run the business and want it corrected or removed, use the “Report this listing” form on its page. Once we have confirmed the request, the listing is removed and is not added again.
12. Marketing and communications
We send messages needed to run the service. We write to a business about its listing once, at an address shown on its own website. Every such message has a link that stops further messages, and you can also stop them at everynearby.com/stop-emails/ or by replying STOP. An address on our stop list is kept only so that we do not write to it again. We send promotional messages only where you have agreed to receive them, and you can withdraw that agreement at any time. If you agree to receive them, promotional messages are chosen using the city and interests you gave us. We do not pass your city, interests or contact details to businesses or advertisers.
13. Third-party websites
The Platform links to businesses’ own websites and to services such as maps and messaging apps. Their privacy practices are their own, and we encourage you to read their policies.
14. Grievance redressal
In accordance with the Information Technology Act, 2000 and the rules made under it, we have designated a Grievance Redressal Officer to address complaints about the Platform, its content or these terms.

16. Amendments
We may update this Policy to reflect changes in our practices, technology or the law. Material changes will be shown by a notice on the Platform. Your continued use of the Platform after a change is published is your acceptance of the revised Policy.
