1. About these terms
EveryNearby (“EveryNearby”, “we”, “us” or “our”) is operated by Irfan Rais, an individual proprietor trading as EveryNearby, with a contact address at Hyderabad, Telangana 500001, India. We operate a directory of local businesses at www.everynearby.com (the “Platform”).
These Terms of Service govern your access to and use of the Platform. By visiting, registering on or using the Platform, you confirm that you have read these Terms, understood them and agree to be bound by them. If you do not agree, please do not use the Platform.
These Terms are an electronic record under the Information Technology Act, 2000 and do not require a physical, electronic or digital signature.
2. Our service
EveryNearby lists businesses so that people can find and contact them. Through the Platform you can:
- Browse and search listings by city, area and category
- Contact a business by phone, website or directions, and by WhatsApp or an enquiry form where the business offers them
- Read and write reviews
- If you run a business, claim your listing or add it if it is not listed, correct its details and see how often people contact you through it
We do not sell the goods or services of listed businesses, take bookings or payments for them, or act as their agent. Any arrangement you make with a business is between you and that business.
The nature and availability of the service may change. We may add, change, suspend or discontinue any part of it at any time, with or without notice.
3. Eligibility
To create an account or submit content you must:
- Be at least 18 years of age or the age of majority where you live, whichever is higher
- Be legally capable of entering into a binding contract
- Not have been suspended or removed from the Platform by us
4. Account registration and security
- You must give accurate information when you register and keep it up to date.
- You sign in with a code sent to your email address or mobile number. You must have confirmed one of them before you can claim or add a business.
- You are responsible for keeping your sign-in codes, and any password, confidential and for everything done through your account.
- Tell us at once at info@everynearby.com if you believe your account has been used without your permission.
5. Listings and claims
- Listings that have not been claimed start from open place data; see our Data Sources page. They may contain errors.
- “Checked” means we confirmed the stated detail on the date shown. It is not a recommendation and says nothing about quality, safety, pricing or licensing beyond what the listing states.
- To claim or add a listing you must be the owner of the business or authorised by it. We verify claims by a code sent to the phone number shown on the listing or to a contact on the business’s own website, or by proof that we review. We may refuse or reverse a claim, or decline a new listing, that we cannot confirm.
- Once you claim or add a listing, you are responsible for the accuracy of the details you provide. Changes to a name, phone number, address, website or category appear automatically within about 15 minutes.
- No badge, including “Claimed”, “Licence checked”, “GST registered”, “Phone verified” and “Email verified”, and no position in a list can be bought.
- If two people claim the same business, we decide who manages the listing in the way set out in our Listing and Content Policy. That decision concerns the listing on the Platform only. It does not decide who legally owns the business, its name or any trade mark.
- A business may ask for its listing to be corrected or removed at any time using the “Report this listing” form.
6. Reviews and other content you submit
When you submit a review, correction, report or business details (“Your Content”), you confirm that it is true, that it is your own, and that you have the right to share it. You grant us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce and edit Your Content for length or clarity in connection with the Platform. Reviews are also governed by our Review Policy.
7. Acceptable use
By using the Platform, you agree not to:
- Post or send content that is unlawful, false, defamatory, abusive, obscene or otherwise objectionable
- Impersonate any person or business, or claim a listing you are not authorised to manage
- Post reviews of your own business or a competitor’s, or reviews given in exchange for payment or reward
- Use any automated means, including bots, scrapers or spiders, to access, monitor or copy content from the Platform, other than search engines and assistants that follow our robots.txt file
- Use contact details obtained from the Platform to send unsolicited commercial communications
- Transmit viruses or other malicious code, or interfere with the working of the Platform
- Violate any applicable law, regulation or court order
8. Enquiries and contacting businesses
An enquiry you send through the Platform goes only to the business you send it to. We are not responsible for a business’s reply, or for its failure to reply. Calls, WhatsApp messages and visits to a business’s website take place outside the Platform.
9. Fees
Browsing the Platform, claiming or adding a listing and managing it are free. If we introduce paid services in future, they will be offered under separate terms that you may accept or decline.
10. Intellectual property
The Platform’s design, text, graphics, logos, software and the compilation of listings, other than open data credited on the Data Sources page and content supplied by businesses and reviewers, are the property of EveryNearby or its licensors. You are granted a limited, personal, non-exclusive, non-transferable licence to use the Platform for its intended purpose. You may not reproduce, distribute, modify or commercially exploit any part of it without our prior written consent.
11. Copyright takedown procedure
If you believe that content on the Platform infringes your copyright, send a written notice to info@everynearby.com containing:
- Your full name, postal address, telephone number and email address
- A description of the copyrighted work you say has been infringed
- A description of the material and where it appears on the Platform
- Evidence that you are the rights holder or the rights holder’s authorised agent
- A statement of good-faith belief that the use of the material is not authorised
We will remove or disable access to material that infringes.
12. Third-party content and links
Listings link to businesses’ own websites and to third-party services such as maps and messaging apps. We do not control those services and are not responsible for their content, availability or practices.
13. Disclaimers
The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that:
- The Platform will be uninterrupted, error-free or free of harmful components
- Any listing is complete, accurate or current at all times
- Any business listed is licensed, competent, safe or suitable for your purpose
You are responsible for your own decisions about which business to use.
14. Limitation of liability
To the fullest extent permitted by applicable law:
- EveryNearby and its officers, employees, agents and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data, goodwill or business opportunities
- We are not liable for any loss arising from your dealings with a listed business
- The Platform is provided free of charge, and we accept no liability to you, of any kind, for any claim under or in connection with these Terms or your use of the Platform
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law
15. Indemnification
You agree to indemnify and hold harmless EveryNearby and its officers, employees and agents from any claim, loss or expense, including reasonable legal fees, arising from Your Content, your breach of these Terms, or your violation of any law or the rights of a third party.
16. Suspension and termination
You may close your account at any time by writing to info@everynearby.com. We may suspend or terminate an account, remove a listing or review, or restrict access to the Platform where we have reason to believe these Terms or the law have been breached, or where we receive a lawful order. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and indemnification, continue to apply.
17. Communications
We send messages needed to run the service: codes and links to confirm your email address or claim, enquiries addressed to your business, and notices about your listing or account. We may email a business once, at the address published on its own website, to tell it about its listing; every such message includes a way to stop further messages, and anyone can stop them at everynearby.com/stop-emails/. We send promotional messages only where you have agreed to receive them.
18. General provisions
Force majeure
We shall not be liable for any delay or failure to perform arising from causes beyond our reasonable control, including natural disasters, epidemics, war, civil unrest, government orders, power failures, strikes or internet service disruptions.
Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana, India.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force.
Amendments
We may revise these Terms at any time. Material changes will be shown by a notice on the Platform. Your continued use of the Platform after a change is published is your acceptance of the revised Terms.
19. Grievance redressal
In accordance with the Information Technology Act, 2000 and the rules made under it, we have designated a Grievance Redressal Officer to address complaints about the Platform, its content or these terms.
